پی ٹی آئی کی ممنوع اور غیر ملکی فنڈنگ کیس کا تاریخی فیصلہ - ماضی کے جھروکوں سے انجینئر ممتاز ہاشمی کینیڈا

آخرکار 8 سال کی طویل اور صبر آزما جدوجہد کے نتیجے میں پئ ٹی آئی کے بانی رکن اکبر بابر کو انصاف مل گیا اس پر ان جرات کو خراج تحسین پیش نہ کرنا بہت زیادتی ہوگی اس دوران ان پر کسی قسم کے دباؤ کا سامنا کیا ہو گا اس سے ہم بخوبی 

اندازہ لگا سکتے ہیں۔ اس سلسلے میں چیف الیکشن کمشنر کا کردار بھی انتہائی دلیرانہ رہا ہے اس بات کا اندازہ ان واقعات سے کیا جا سکتا ہے جو کچھ عرصہ سے عمران خان ان کی کردار کشی کی مذموم مہم چلا رہا تھا تاکہ ان کو دباؤ میں لا کر اس فیصلے کو مزید تاخیر سے ہمکنار کیا جائے۔ واضح رہے کہ چند ماہ قبل تک جب عمران خان برسراقتدار تھا تو اس نے اسی چیف الیکشن کمشنر جو کہ اس کا اپنا تجویز کردہ ہے کی ایمانداری کی بہت تعریف کی تھی لیکن جب اس نے تمام ذرائع استعمال کرتے ہوئے اس کو دبانے اور تاخیری حربے میں ناکام رہا تو اس فیصلے سے قبل ہی اس کو بدنام کرنے کی ایک جھوٹ پر مبنی مم شروع کر دی۔

ان تمام حقائق سے واضح ہو جاتا ہے کی اس نے جو غیر آئینی طریقے سے ممنوعہ اور غیر ملکی فنڈنگ کی تھی اس کے نتائج سے وہ بخوبی واقف تھا۔

آج کے فیصلے کو سمجھنے کے لیے آئین اور قوانین جو کی کسی بھی سیاسی جماعت کی تشکیل اور اس کی فنڈنگ سے متعلق ہیں ان کو ذہن نشین رکھنا ہوگا 

آئین کے آرٹیکل 17 کے تحت سیاسی جماعتوں کی تشکیل کا دائرہ کار متعین کیا گیا ہے جس کے تحت ہر پاکستانی ماسوائے سرکاری ملازم کسی بھی پارٹی کی تشکیل اور اس کا ممبر و عہدے دار ہو سکتا ہے اور اس کی فنڈنگ کا دائرہ کار پولیٹیکل پارٹیز ایکٹ میں متعین کیا گیا ان قوانین کے مطابق ہر پارٹی اپنی فنڈنگ خا مکمل حساب رکھنے اور اس کو الیکشن کمیشن میں پیش کرنے کی پابند ہے کوئی بھی پاکستانی کسی بھی پارٹی کو فنڈنگ کر سکتا ہے اور یہ فنڈنگ قانونی کہلاتی ہے کوئی پاکستانی یا بیرونی ممالک میں قائم کمپنی، ادارے یا غیر پاکستانی کسی بھی پاکستانی پارٹی کو فنڈنگ نہیں کر سکتے اور اگر کوئی ایسا کرنا ممنوعہ فنڈنگ کے دائرہ میں آتا ہے اسی طرح اگر کوئی پاکستانی رجسٹر سیاسی جماعت کسی غیر ملکی باشندے، کمپنی، ادارے یا حکومت سے فنڈنگ وصول کرتی ہے تو اس جماعت کو اس قانون کی روشنی میں غیر ملکی فنڈنگ پارٹی کہا جاتا ہے۔

آج کے فیصلے کی روح سے مندرجہ ذیل چیزیں ثابت ہوئی ہیں 

تحریک انصاف نے ممنوعہ فنڈز لیے  

پی ٹی آئی امریکہ، کینیڈا سے ملنے والی فنڈنگ ممنوعہ قرار

ووڈن کرکٹ سے ملنے والی فنڈنگ ممنوعہ قرار

تحریک انصاف پر ممنوعہ/ غیرملکی فنڈنگ کا الزام ثابت ہوگیا

 تحریک انصاف نے 34 غیر ملکی باشندوں اور 351 غیر ملکی کمپنیوں سے فنڈنگ لی ہے۔ 

 تحریک انصاف 13 اکاونٹس کا ریکارڈ نہ دے سکی۔ 13 نامعلوم اکاونٹس سامنے آئے ہیں 

 چیئرمین تحریک انصاف نے اکاؤنٹس چھپائے ، اکاؤنٹس چھپانا آئین کی خلاف ورزی ہے

ان تمام حقائق کو سامنے رکھتے ہوئے الیکشن کمیشن نے ان اقدامات کا اعلان کیا ہے 

تحریک انصاف کو ممنوعہ فنڈنگ ثابت ہونے پر شوکاز نوٹس جاری

مزید کارروائی کے لیے الیکشن کمیشن اور وفاقی حکومت کو ہدایت 

اب اس بات میں کوئی شک نہیں کہ اگلے مرحلے میں فنڈنگ کو ضبطی کی طرف قانونی کارروائی کی جائے گی 

وفاقی حکومت اس فیصلے کے تحت پی ٹی آئی کو غیر قانونی پارٹی قرار دینے اور اس کی تحلیل کے لیے قانونی اقدامات شروع کرنے کی پابندی ہو گی 

اس فیصلے کے تحت عمران خان نے بحیثیت چیرمین ھو حلف نامے جمع کرانے تھے وہ جھوٹ پر مبنی تھے

اس فیصلے کے تحت 13 اکاونٹس کو پوشیدہ رکھا گیا جو کہ بددیانتی اور بے ایمانی کے زمرے میں آتا ہے اور ان میں اکثر اکاونٹس عمران خان اور دوسرے پارٹی کے اہم رہنماؤں کے نام سے کھولا گیا تھا 

یہ بات بھی ذہن نشین رکھنا ضروری ہے کہ جب عمران خان کو ثاقب نثار نے صادق اور امین ڈکلیر کیا تھا تو اس میں بھی اس بھی اس کیس کا حوالہ دیا گیا تھا اور اس کے فیصلے کو مستقبل میں دوبارہ سے جانچنے کا ذکر کیا گیا ہے آج کے فیصلے کے بعد اس پر مزید کارروائی شروع ہو سکتی ہے جو کہ عمران خان کی نااہلی کا باعث بن سکتی ہے 

ان تمام حقائق سے ہٹ کر سب سے زیادہ تشویش ناک بات جو اس غیر ملکی فنڈنگ سے سامنے ارہی ہے وہ ان ممالک کا پاکستان کے مفادات کے خلاف پی ٹی آئی کو استعمال کرنے کا ہے واضح رہے کہ یہ فنڈنگ جن اوقات میں کی گئی اس وقت عمران خان کو لانچ کیا گیا تھا اور اسلام آباد میں دھرنا دینے کا مقصد پاکستان چائنا اکانومی کوریڈور کی راہ میں رکاوٹ ڈالنے اور اس کو ناکام بنانے کا تھا جس کا پاکستان کو شدید نقصان پہنچایا گیا اور پاکستان کی دشمنیوں کے ایجنڈے کی تکمیل کی گئی۔

امید ہے کہ آج جب کہ جھوٹے، مکار، کرپٹ اور دوسروں کے ایجنڈے پر کام کرنے والے عمران خان کا گھناؤنا چہرہ پوری طرح بے نقاب ہو چکا ہے تو اس کے وہ تمام حمایتی جو ناسمجھی میں اس کا ساتھ دیتے رہے ہیں اب اس سے مکمل علیحدگی اختیار کرتے ہوئے اپنے محب وطن ہونے کا ثبوت فراہم کریں گے

Finally, as a result of 8 years of long and patient struggle, PTI founder member Akbar Babar got justice. We are fine with that 

Can guess. In this regard, the role of the Chief Election Commissioner has also been very courageous, it can be estimated from the events that for some time Imran Khan was running a nefarious campaign to kill his character in order to pressure him to take this decision. Further delay should be tolerated. It should be noted that till a few months ago, when Imran Khan was in power, he greatly appreciated the honesty of the same Chief Election Commissioner who was his own recommendation, but when he used all means to suppress and delay him. Failing that, he started a false mum to discredit him even before the verdict.

All these facts make it clear that he was well aware of the consequences of the unconstitutional contraband and foreign funding he did.

In order to understand today's decision, the Constitution and the laws governing the formation and funding of any political party have to be kept in mind. 

Under Article 17 of the Constitution, the scope of formation of political parties has been defined, according to which every Pakistani except the government employee can form any party and be a member and office bearer and the scope of its funding is under the Political Parties Act. According to these rules, every party is obliged to keep a complete account of its funding and submit it to the Election Commission. An established company, institution or non-Pakistani cannot fund any Pakistani party and if doing so falls within the scope of prohibited funding similarly if a Pakistani registered political party receives funding from a foreign resident, company, institution or government. If so, this party is called a foreign funding party in the light of this law.

In the spirit of today's judgment the following things have been established 

PTI took prohibited funds  

Funding received by PTI from USA, Canada prohibited

Funding from wooden cricket prohibited

Allegation of Prohibited/Foreign Funding on Tehreek-e-Insaf proved

 PTI has received funding from 34 foreign residents and 351 foreign companies. 

 Tehreek-e-Insaf could not provide records of 13 accounts. 13 unknown accounts have been revealed 

 Chairman Tehreek-e-Insaf hid accounts, hiding accounts is a violation of the constitution

Keeping all these facts in front, the Election Commission has announced these measures 

Prohibited funding to Tehreek-e-Insaf issued show cause notice

Instructions to Election Commission and Federal Government for further action 

Now there is no doubt that the next step will be legal action to confiscate the funding 

The federal government will be barred from declaring PTI an illegal party and taking legal steps to dissolve it under this decision. 

According to this decision, Imran Khan as the chairman had to submit affidavits, they were based on lies

Under this decision, 13 accounts were kept hidden, which fall under the category of malpractice and dishonesty, and most of them were opened in the name of Imran Khan and other important party leaders. 

It is also important to note that when Imran Khan was declared Sadiq and Amin by Saqib Nisar, this case was also referred to and his decision mentioned to be re-examined in the future. After today's decision, further action may be initiated which may lead to Imran Khan's disqualification 

Apart from all these facts, the most worrisome thing that is coming out from this foreign funding is the use of PTI by these countries against the interests of Pakistan. Imran Khan was launched and the dharna in Islamabad was aimed at obstructing and thwarting the Pakistan China Economic Corridor, which would cause serious damage to Pakistan and further Pakistan's hostile agenda.

It is hoped that today, when the ugly face of Imran Khan, who is a liar, hypocrite, corrupt and working on the agenda of others, has been fully exposed, then all his supporters who have been supporting him in the wrong way are now fully aware of it. They will provide proof of their patriotism by secession
