
Islamabad (Rana Masood Hussain) During the hearing of the case related to holding general elections in the Supreme Court, the Election Commission submitted a notification regarding the holding of general elections on February 8, 2024 and assured that this is the final date, on which the court approved the federal government. Ordered the government to ensure the holding of general elections on 8th February 2024 across the country. The court ruled in its order that the President and the Election Commission gave a date for holding general elections in the entire country, the federal government and the provincial governments agreed that the elections would be held without any disturbance, the Attorney General also on February 8. There was no objection to the holding of the general elections, the court disposed of all the petitions filed related to the holding of the elections within 90 days with this order. The general elections will be held on February 8, the Election Commission will release the election schedule after the constituencies, the notification of the date of the general elections has also been issued, no party has any objection to holding the elections on February 8, so the federal government will hold the elections on February 8, 2024. While the Election Commission should announce the election schedule after fulfilling all the necessary requirements, the Supreme Court has said in its order that the National Assembly was dissolved when there was no confidence against the Prime Minister, the Prime Minister did not have the authority to dissolve the National Assembly. 
The prime minister of that time created a constitutional crisis by dissolving the assembly. It is strange that the president used the constitutional authority which was not his, the consequences of which could be dangerous. It was a victim, the constitution was violated 15 years ago today, we should learn from the history of flouting the constitution that it has negative effects on the people and geographical boundaries, it was unconstitutional for the president to dissolve the assembly after the motion of no confidence. The Chief Justice has said that if I am alive, there will be elections for the national and all provincial assemblies on Thursday, February 8, God willing. If the Election Commission cannot hold elections, then go home. That the constitution was violated 15 years ago today and the violation of the constitution continues till today, we should learn from the history of violation of the constitution, we have to learn from the history of flouting the constitution that people and geographical boundaries It has negative effects. Violation of the constitution also affects the people and the land of Pakistan. The Chief Justice said that if the media creates doubts about the elections, they will be guilty of violating the constitution.

Otherwise, action will be taken against it. If any media house creates confusion regarding the election, the Election Commission will file a complaint against it. The media cannot hold the mic and say that there is doubt in the conduct of the election. ? But don't influence the people, tell the media people that it is not their right to tell lies, the freedom of the media is given in the constitution, we cannot take action against the media, if any media person has doubts about the elections, he will not say yes in public but his own. He can tell his wife, lest this happens, this news will be broadcast on TV in the evening He said that it is not known whether the elections will be held or not. He said that the public opinion is affected by the news of the non-holding of elections in the media. Do not be under the misconception that we have given the date of the elections, Article 19 regarding expression of opinion is still there, but the implementation of the constitution is also a duty on every citizen, God willing, everyone will fulfill their constitutional responsibility.
Earlier, a three-member bench headed by Chief Justice Qazi Faiz Isa, comprising Justice Athar Minullah and Justice Aminuddin Khan started the hearing, Tehreek-e-Insaf's lawyer Barrister Ali Zafar and the Attorney General appeared and the Attorney General announced the election of the Chief Election Commissioner. The minutes of the meeting between the President and the Election Commission delegation were also presented. The Chief Justice said that the record was not signed by the President. He said that the President of the country has given his consent letter separately, the Chief Justice said that where is the letter, how far is the President's House from here, we will not leave it like this, the official confirmation of the President should be done, after which in the hearing. Adjournment was made, after the adjournment, the Attorney General presented the notification of the Election Commission regarding holding the general elections on February 8, after which the Chief Justice started writing the order. The court declared that after the meeting on November 2, 2023, the election date Agreed, the National Assembly was dissolved on the advice of the Prime Minister and it is an admitted fact that after the dissolution of the National Assembly there was a difference between the President and the Election Commission, the four provincial Advocate Generals did not raise any objection to the decree.

The President wrote in the letter that the Election Commission should consult with the provincial governments to announce the date. The Election Commission did not respond to the President's letter. The Supreme Court has no role in the matter of giving the date. position, I wonder how they came to this conclusion, if the President of the State needed an opinion from the Supreme Court, he could have referred it here under Article 186 of the Constitution, every person holding a constitutional position and constitutional institution, including the Election Commission and the President. It is bound by the constitution, violation of the constitution has serious consequences, because of the President and the Election Commission, this matter came to the Supreme Court unnecessarily, the Supreme Court is aware that we cannot interfere with the powers of the President and the Election Commission.
The entire country was worried about not announcing the date of the elections. The Supreme Court can only ask for consultation between the President and the Election Commission as a facilitator. This court can only say that each institution within its limits. live and work, both the President of the State or the Election Commission have a great responsibility, improving the favorable environment for elections is the basic right of every citizen, this responsibility is imposed on those who have taken this oath, Chief Election Commissioners, members and the President take oath, the people cannot be kept away from the implementation of the Constitution by the President or the Election Commission.
