Islamabad:
The Election Commission of Pakistan is worried about the explanation of the 8
judges of the Supreme Court regarding the questions of the Commission regarding
the short order of the Supreme Court of July 12 in the case of special seats.
Commission sources have told The News on condition of anonymity that the
commission is a constitutional body and therefore will not come under pressure
from anyone. Referring to the tone and tenor of the Supreme Court's
clarification regarding the Election Commission, these sources said that such
treatment of a constitutional institution is highly unfair. The impression that
the Election Commission has recognized Barrister Gohar Ali Khan as the Chairman
of PTI is not correct. The issue of PTI's intra-party election is still pending
in the Election Commission and no final decision has been taken on it. The
Election Commission has always tried to resolve this issue as soon as possible.
However, the PTI has repeatedly resorted to delaying tactics. Sources say that
the Supreme Court has given its summary judgment on certain seats on July 12,
2024. In response, the Election Commission filed its CMA within the statutory
period, i.e. on 25 July 2024.
However,
after almost 2 months, on 14 September 2024, the Supreme Court passed an order
on the CMA. The Election Commission is not responsible for any delay in
implementing the Supreme Court's decision. The Election Commission is a
constitutional body and it Will not accept any threat against him. Such
treatment of constitutional institutions is absolutely inappropriate. The
Supreme Court on Saturday reprimanded the Election Commission, saying that the
commission was using delaying tactics in implementing the July 12 decision, and
at the same time, PTI was entitled to reserved seats. In the explanation of the
8 judges, the Election Commission has been told that if it does not fulfill its
legal obligations, there will be serious consequences. The judges, in their
explanation, have said that after considering the record placed before the
court and the brief order, there is no doubt that the explanation sought by the
commission is deliberate. Nothing but a manufactured delaying tactic.
The
Election Commission, through its Secretary Umar Hamid Khan, had applied to the
Registrar of the Supreme Court to issue a detailed decision on July 12 about
the PTI-backed independent candidates. In a brief judgment, the Supreme Court
declared the former ruling party eligible for reserved seats. After the Supreme
Court's July 12 verdict, PTI MPs in the National and Provincial Assemblies
submitted affidavits of allegiance to the party founded by Imran Khan in the
Election Commission. The Election Commission pointed to its record that
Barrister Gohar Ali Khan was not authorized as party chairman, resulting in
"validly selected organizational positions" for the party by an
"unauthorized person". A question mark was raised on the verification
of the affidavits of these parliamentarians in the absence of any organization.
