Questions of Chief Justice after the "order" of 8 Supreme Court Judges


Islamabad (EWN) According to reliable sources, Chief Justice of Pakistan, Justice Qazi Faiz Isa raised questions after the "order" of 8 judges in the case of reserved seats and in this meeting, Fazil Chief has asked for answers to 9 questions. Justice has questioned that when did the Election Commission and Tehreek-e-Insaf file an explanation request? In which court room or chamber the petitions were heard, why the cause list was not issued for the judgment, notices were issued to the concerned parties and the Attorney General? According to the details, Chief Justice Qazi Faiz Isa issued an order based on the explanation of the 8 majority judges regarding the hearing of various applications of the Election Commission and PTI on September 14 in the case of specific seats (recorded by the Deputy Registrar (Judicial) on the same day). (In the light of the note, 9 questions have been answered. (1) When did the Election Commission and Pakistan Tehreek-e-Insaf file the clarification requests for correctness of the ambiguity regarding the short decision of the court on July 12? (Second) PTI and Election Commission. 

Why were these miscellaneous petitions not sent to the three-member committee set up under the Supreme Court (Practice Procedure) Act, 2023 for consideration? (IV) Did the registrar's office issue notices to the relevant parties in the case and the Attorney General in this regard? (V) In which courtroom or which judge's chamber were these applications heard? (VI) Why was the list of causes not issued after the hearing of the various petitions for the issuance of their decision? How was this order uploaded on the website of the Supreme Court without submitting the original file and order of the in-chamber hearing to the Registrar's Office? It should be remembered that 8 judges included in the 13-member full court bench of the court, Justice Mansoor Ali Shah, Justice Muneeb Akhtar, Justice Muhammad Ali Mazhar, Justice Ayesha Malik, Justice Athar Manullah, Justice Syed Hasan Azhar Rizvi and Justice Irfan Saadat Khan on 12 July 2024 And against the Election Commission/Pashaw Release Court's decision to allocate reserved seats for women and minorities in provincial assemblies (supported by PTI) to other parliamentary parties instead of giving them to the Sunni Ittehad Council on the basis of members. In its majority (abbreviated) judgment issued after the hearing of the appeals filed by the Sunni Ittehad Council, annulled the decisions of the Election Commission and the Peshawar High Court and stated that the PTI was, and is, a political party, not having an electoral symbol. 

Whether or not it does not affect the legal status of a political party, in the unanimous decision of eight judges, out of the 80 members of the National Assembly declared independent by the Election Commission, 39 members of the National Assembly were nominated by PTI, while the rest remained. Declaring the 41 members of the National Assembly as independent members, they said that within 15 days of the court's decision, the independent members should also submit an affidavit of affiliation to their political party in the Election Commission and in case of confirmation of the said party. The members of the National Assembly will also be considered candidates of the same party, the court immediately informed the Election Commission on this decisionWhile directing the implementation, it was made clear that in case of non-implementation of this decision, he may have to face the consequences.
